  • "Client", "you", "your" refers to the user or organization using our services.

  • "Services" include, but are not limited to, marketplace management, digital marketing, software development, graphic design, staffing, and business process outsourcing (BPO).

2. Use of Services

  • Our services are provided on a project, contract, or subscription basis as mutually agreed.

  • You agree to provide accurate, current, and complete information for project execution.

  • Jaincotech reserves the right to refuse or terminate services if any information is found to be false or misleading.

3. Intellectual Property

  • All materials, designs, content, and code produced by Jaincotech remain the intellectual property of the company unless otherwise stated in a written agreement.

  • You may not reuse, copy, or redistribute any content without prior written permission.

4. Confidentiality

  • Both parties agree to maintain the confidentiality of all non-public, proprietary information shared during the course of engagement.

  • Confidential information will not be disclosed to third parties without explicit written consent.

5. Payment Terms

  • Payment structures are defined in individual service agreements or invoices.

  • Late payments may incur penalties or suspension of services.

  • All fees are exclusive of applicable taxes, which shall be borne by the client.

6. Service Timelines and Delivery

  • Estimated timelines will be provided but are subject to change due to client delays, scope modifications, or unforeseen technical challenges.

  • Jaincotech will keep clients informed of progress and changes as needed.

7. Warranties and Disclaimers

  • Jaincotech makes no guarantees regarding specific results, including sales, rankings, or performance, unless otherwise documented.

  • Our services are provided "as-is" and "as-available". We do not warrant uninterrupted or error-free operation.

8. Limitation of Liability

  • Jaincotech shall not be held liable for any indirect, incidental, or consequential damages arising out of service use, delays, or data loss.

  • Our maximum liability under any agreement shall not exceed the total fees paid by the client in the previous 90 days.

9. Termination

  • Either party may terminate the agreement with 15 days written notice.

  • In case of early termination, the client agrees to pay for all completed work and any unrecoverable project expenses.

10. Third-Party Services

  • Jaincotech may integrate or use third-party tools (e.g., Google Ads, AWS, CRM platforms). We are not liable for issues originating from these third-party platforms.

11. Changes to Terms

  • Jaincotech reserves the right to update or modify these Terms at any time. We recommend reviewing this page regularly.

  • Continued use of services after changes constitutes your acceptance of the revised Terms.

12. Governing Law

  • These Terms shall be governed by the laws of India and the United States, based on the jurisdiction of service delivery.
